  • “Services” means the roofing, HVAC, window, screen room, and carport services described in Section 5.
  • “Agreement” means these Terms together with any written quotations, estimates, or contracts entered into with the Company.
4. Eligibility and User Commitments

If you are acting on behalf of a company or other entity, you represent that you are duly authorized to bind that entity. You further agree to provide accurate and complete information when requesting Services, and to comply with all applicable laws, codes, and association rules in connection with our work.

5. Scope of Services

The Company offers a range of residential and commercial construction and improvement Services, including:

  • Installation, repair, and replacement of shingle, metal, TPO, flat, modified, and tile roofing systems;
  • Construction of screen rooms and carports;
  • Installation of HVAC systems; and
  • Installation and replacement of windows.

Descriptions of Services on the Website are provided for informational purposes only and do not constitute binding offers. Scope, pricing, and timelines are established solely through written proposals or contracts executed by both parties. The Company also provides certain renewable energy products, including solar battery systems and related installations, subject to availability and applicable permitting.

6. Quotations, Estimates, and Service Orders

Quotations and estimates provided by the Company are non-binding until accepted in writing by both parties. Unless otherwise stated, quotations are valid for thirty (30) days. Final pricing may vary due to site conditions, changes in material costs, or other factors. Work will not commence until:

  • A written agreement or work order has been executed; and
  • Any required deposit has been received.

The Company reserves the right to revise or withdraw an estimate in its sole discretion.

Services are available only within the Company’s designated service areas as published on the Website or disclosed by the Company at the time of inquiry. Requests outside these areas may be declined.

7. Payments and Billing

Customers agree to make payment for Services in accordance with the terms of the applicable contract or invoice.

  • Accepted Methods: We accept online credit and debit card payments, ACH transfers, in-person payments, cash, and checks.
  • Deposits: Certain projects require an advance deposit, which will be applied toward the total contract price.
  • Due Dates: Payments are due on the schedule set forth in the written agreement. Late payments may accrue interest at the maximum rate permitted by law.
  • Returned Items: Customers are responsible for fees arising from returned checks or failed electronic payments.

The Company reserves the right to suspend or terminate Services for non-payment.

Customers making payments through the Company’s online payment portal authorize the Company and its payment processor to initiate electronic debits and credits as necessary to process transactions. Customers are responsible for maintaining the confidentiality of their payment credentials. The Company is not liable for losses resulting from unauthorized access to a Customer’s device or online account.

7A. Financing

From time to time, the Company may make financing options available through third-party lenders. Any financing is subject exclusively to the terms and conditions of the applicable lender. The Company is not a party to, and shall not be responsible for, the approval, denial, enforcement, or administration of any financing arrangement. Customers remain obligated to the Company for payment of amounts due for Services, regardless of any financing arrangements.

8. Refunds and Right of Rescission

Customers are entitled to a three (3) day right of rescission from the date of executing a contract with the Company. To exercise this right, you must deliver written notice of cancellation within the rescission period. Refunds of deposits or other payments will be processed promptly and in accordance with applicable law. After the rescission period, cancellations are subject to the specific terms of the written agreement and may result in the forfeiture of deposits or imposition of cancellation fees.

9. Warranties and Guarantees

The Company stands behind the quality of its workmanship and provides a one-year workmanship warranty for Services performed. In addition, certain materials may carry manufacturer warranties. The duration and coverage of such warranties vary by manufacturer, and the Company does not assume responsibility for their enforcement. We will, however, provide reasonable assistance to Customers in submitting manufacturer warranty claims. Except as expressly stated in this Section, the Company disclaims all other warranties, whether express or implied, to the fullest extent permitted by law.

10. Promotions, Discounts, and Special Offers

From time to time, the Company may advertise promotions or special pricing. All such offers are subject to the express condition that they may not be combined with any other discount or incentive. The phrase “not valid with any other offer” means that only one promotion may be applied to a single transaction. By way of example:

  • A Customer holding a coupon for ten percent (10%) off may not also apply a “buy-one-get-one-free” offer;
  • A manufacturer’s rebate and a Company discount cannot be used together unless expressly permitted;
  • Promotional codes may not be used on already discounted or clearance items; and
  • Loyalty rewards cannot be combined with a separate promotional discount.

The Company reserves the right to modify or terminate promotions at its discretion.

11. Customer Responsibilities

Customers are expected to cooperate with the Company to facilitate timely and efficient performance of the Services. This includes providing access to the property, securing permits or approvals not expressly undertaken by the Company, and ensuring compliance with applicable zoning laws or homeowners’ association rules. Customers must also disclose any known conditions at the property that may affect the Services. The Company shall not be liable for delays, increased costs, or damages caused by a Customer’s failure to fulfill these obligations.

12. Scheduling and Project Delays

The Company will endeavor to accommodate Customer preferences in scheduling, but all dates are subject to availability and may change due to factors beyond our control. Delays may result from severe weather, shortages in materials, labor conditions, or other unforeseen events. In such cases, the Company shall not be liable for losses or damages arising from the delay. If delays occur, the Company will notify the Customer and reschedule performance of the Services within a commercially reasonable time.

13. Consent to Communications

By providing your contact information to the Company, you consent to receive communications by telephone, text message, and email regarding quotations, scheduling, billing, and ongoing projects. Standard carrier charges may apply to text messages. You may opt out of marketing communications at any time by following the unsubscribe instructions provided in the message or by contacting the Company directly. Opting out of marketing communications will not affect our ability to send operational or service-related messages.

14. Privacy and Data Use

The Company collects and uses Customer information as necessary to provide the Services, process payments, and communicate regarding ongoing projects. We do not sell Customer information to third parties. The manner in which we collect, use, and safeguard data is further described in our Privacy Policy, which is incorporated into these Terms by reference. Customers are encouraged to review the Privacy Policy to understand our data practices in detail.

15. Cookie Usage

The Website uses cookies and similar technologies to enhance functionality, improve user experience, and analyze site traffic. Cookies may include essential technical files, performance tracking tools, and functionality enhancers. By using the Website, you consent to the placement and use of such cookies as described in our Cookie Policy, which is incorporated by reference. You may adjust your browser settings to block or delete cookies, though doing so may impair the performance of the Website.

16. User Content and Testimonials

From time to time, Customers may submit reviews, testimonials, photographs, or other content (“User Content”). By submitting User Content, you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display such material in connection with the promotion of our Services. You represent that any User Content submitted is accurate, lawful, and does not infringe the rights of third parties. The Company reserves the right to remove or decline to use User Content at its discretion.

17. Intellectual Property Rights

All content on the Website, including text, images, graphics, logos, and software, is the property of the Company or its licensors and is protected by intellectual property laws. Customers may access and use the Website solely for personal or internal business purposes. No right, title, or interest in the Website content is transferred to you, and you may not copy, distribute, modify, or create derivative works from the Website without prior written consent of the Company.

18. Third-Party Services and Vendors

The Company may rely on third-party service providers in connection with hosting, analytics, payment processing, or materials supply. While the Company endeavors to work with reputable vendors, it does not control and is not responsible for the conduct, availability, or terms of such third parties. Customers acknowledge that use of third-party services may be subject to additional terms and privacy policies imposed by those providers.

19. Disclaimers of Warranties

Except as expressly set forth in Section 9, the Services and the Website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Website will be uninterrupted, secure, or error-free, or that Services will meet every Customer expectation.

20. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to the Website or the Services, even if advised of the possibility of such damages. In no event shall the Company’s aggregate liability exceed the total amount paid by the Customer to the Company for the specific Services giving rise to the claim.

21. Indemnification

Customers agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • The Customer’s breach of these Terms;
  • The Customer’s violation of applicable laws or regulations; or
  • Any claim that Customer-provided information or User Content infringes the rights of a third party.

This obligation shall survive the termination of the Agreement.

22. Termination and Cancellation by Company

The Company reserves the right to suspend or terminate performance of the Services, or to cancel an agreement entirely, if the Customer fails to make timely payment, provides inaccurate or misleading information, obstructs access to the work site, or otherwise engages in conduct that makes performance unsafe or impracticable. Termination under this Section does not relieve the Customer of its obligation to pay for Services rendered or costs incurred up to the date of termination. Opportunities for employment, careers, or contractor engagement advertised on the Website are informational only and are governed by separate application processes and agreements. These Terms do not apply to employment relationships.

23. Dispute Resolution

The Company encourages Customers to resolve concerns informally by contacting us directly. If a dispute cannot be resolved through good-faith negotiation, the parties agree to submit the matter first to non-binding mediation before a mutually agreed mediator located in Hillsborough County, Florida. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, or through litigation in the courts of Hillsborough County, Florida, as applicable. Unless otherwise required by law, each party shall bear its own legal fees and costs.

24. Governing Law

These Terms, and any dispute arising from or relating to them, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Customers expressly consent to the exclusive jurisdiction of the state and federal courts located in Tampa, Florida, for the resolution of any dispute not subject to arbitration.

25. Amendments, Severability, and Contact Information

The Company may amend these Terms from time to time by posting a revised version on the Website with an updated “Effective Date.” Continued use of the Website or Services following the posting of revised Terms constitutes acceptance of those amendments.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
